Terms and Conditions for BudgetFy

BudgetFy is a mobile phone application for ios, developed and offered to you by Jannis Günther („Provider“). It enables its users to track and manage personal finance budget and analyze their income and expenses. Your use of the BudgetFy mobile phone application and all the related services provided through it by Provider is subject to the following terms, which upon your acceptance form a legally binding agreement between you and the Provider. For the avoidance of doubt, such agreement is concluded solely between you and the Provider and there are no other parties to it. BudgetFy is currently available for download free of charge, however it contains in-app purchases to unlock additional features. Provider does not guarantee that BudgetFy or any of its features will always be free and reserves the right, at its sole discretion, to change the pricing at any time.
Acceptance These Terms regulate the legal relationship between you and the Provider. You may not use BudgetFy if you do not accept them. The Terms are made available to you prior to the download of BudgetFy application inside the App Store. By downloading, installing, using or otherwise accessing BudgetFy, you are expressing your acceptance and willingness to be bound by the Terms.

Financial responsibility

BudgetFy is a service that seeks to aid you in your financial choices. Provider does not take any responsibility for your finance, you are ultimately responsible for your money yourself.

BudgetFy Premium

This section only applies when you purchase and/or subscribe to BudgetFy Premium or other paid products. By paying the subscription fee you get access to BudgetFy Premium during the time your subscription is valid, subject to these Terms. All subscriptions with BudgetFy Premium are paid in advance. You may at any time terminate your membership, in which case your membership will still be valid for the subscription time you have already paid for. If you have subscribed to BudgetFy Premium through the use of App Store or any other such service provider, using in-app purchase, you can only cancel your subscription through the use of their services. BudgetFy reserves the right to change the subscription fees from time to time. You hereby consent to start using the Services immediately upon subscribing with BudgetFy Premium or other paid products. This means that you will only have 14 days to withdraw from the contract with BudgetFy from the date you receive confirmation of your subscription via email if you do not start using the Services during that period. All payments handled by Apple, such as in-app purchases, can only be refunded by Apple and with Apple’s consent.

BudgetFy “Premium“ plan allows you to access BudgetFy premium features available at the time of your purchase for as long as those services are available. We make no warranties or representations as to the expected lifetime of the BudgetFy services.

Disclaimer and limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PROVIDER BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF USE, DATA, AND PROFITS, PROPERTY DAMAGE OR OTHER INTANGIBLE OR ECONOMIC LOSS, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE SPENDEE AND INTEGRATED THIRD-PARTY SERVICES, ESPECIALLY DUE TO REDUCTION OF AVAILABILITY, CANCELLATION OR MODIFICIATION, HACKING ATTACKS, FAILURE, MALFUNCTION OR OCCURRENCE OF OTHER ERRORS IN THE OPERATION OF SPENDEE OR INTEGRATED THIRD-PARTY SERVICES, EVEN IF PROVIDER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LIMITATION ABOVE DOES NOT INCLUDE PROVIDER’S LIABILITY FOR FRAUD, MISREPRESENTATION AND PERSONAL INJURY OR DEATH.  You use the Service at your own risk. The Service is provided “AS IS”, without any warranties, and Provider does not warrant that the Service and availability thereof will be uninterrupted or error free. Provider does not assume any responsibility for errors or omissions in the information or software or other documents, including User Material, which are referenced by or linked to. References or links to third parties‘ websites are provided „AS IS“ without warranty of any kind, either express or implied. In no event shall Provider be liable for any indirect or consequential damages, except in cases of intentional misconduct or gross negligence.

Governing law and dispute resolution

These Terms and the use of the Services are governed by the laws of Germany, except for its conflicts of laws principles. All claims arising out of or relating to these Terms or the Service shall be resolved by the public German courts, whereby the District Court of Germany shall be the court of first instance.
